2.1. All shoes provided on loan shall be documented in the Company's Delivery Order (DO), which forms part of this Agreement.

2.2. The Borrower or their authorised representative must sign the DO under "Received By" to acknowledge receipt of the items listed.

2.3. The Borrower shall verify the quantity and condition of all items upon receipt. Any discrepancies or existing damage must be reported to the Company in writing within 24 hours.

2.4. Any additional items provided under the same loan arrangement must be documented in a separate DO, signed upon receipt and subject to this Agreement.

3.1. Ownership

All loaned items remain the property of Colour Haven Sdn Bhd. This arrangement does not constitute a sale, gift or transfer of ownership.

3.2. Usage & Care

The Borrower shall handle all items with reasonable care and use them only for the agreed purpose. Items must not be altered, modified, sold or transferred to another party without prior written approval from the Company.

3.3. Return of Items

All items must be returned by the agreed return date, together with their original packaging and accessories where provided. Items must be returned clean and in their original condition, except for reasonable wear arising from usage expressly approved by the Company. Any extension requires prior written approval.

3.4. Loss & Damage

The Borrower shall be responsible for any loss, theft or damage to the items while in their possession or under their control, excluding reasonable wear arising from approved usage.

For damaged items, the Company may claim reasonable repair or restoration costs. For items that are lost, unreturned or damaged beyond reasonable restoration, the Company may claim compensation up to the corresponding unit prices (U.Price) recorded in the DO, subject to applicable law.

3.5. Late Returns

If the Borrower fails to return the items within seven (7) calendar days after receiving a written reminder, the Company reserves the right to issue an invoice for the unreturned items based on their values stated in the DO, subject to applicable law.

3.6. Return Arrangements

Unless otherwise agreed in writing, the Borrower shall arrange and bear the cost of returning the items. Responsibility for the items remains with the Borrower until they are received by the Company.

3.7. Inspection & Verification

The Company may photograph and inspect all items before release and upon return. Any damage or discrepancies identified upon return shall be communicated to the Borrower.

3.8. Governing Law

This Agreement shall be governed by the laws of Malaysia.

Colour Haven Sdn Bhd collects personal information, including names, NRIC or passport numbers and contact details, directly from the Borrower or their authorised representative for identity verification, loan administration, item recovery and related claims. The information is required to process the loan; failure to provide sufficient information may result in the loan being declined.

Personal data will be kept securely and retained only as long as necessary for these purposes or applicable legal obligations. Where necessary, information may be disclosed to delivery providers, authorised service providers, professional advisers or relevant authorities.

The individual may request access to or correction of their personal data, raise concerns or request limitations on its processing, subject to applicable law, by contacting the Company at its address above or at 03-5631 0107. Personal data will not be used for unrelated marketing without separate permission.

Colour Haven Sdn Bhd mengumpul maklumat peribadi, termasuk nama, nombor kad pengenalan atau pasport dan maklumat hubungan, secara langsung daripada Peminjam atau wakilnya yang diberi kuasa bagi tujuan pengesahan identiti, pengurusan pinjaman, pemulangan barangan dan tuntutan berkaitan. Maklumat ini diperlukan untuk memproses pinjaman. Kegagalan memberikan maklumat yang mencukupi boleh menyebabkan permohonan pinjaman ditolak.

Data peribadi akan disimpan dengan selamat dan hanya selama tempoh yang diperlukan bagi tujuan tersebut atau untuk memenuhi kewajipan undang-undang. Jika perlu, maklumat boleh didedahkan kepada penyedia perkhidmatan penghantaran, penyedia perkhidmatan yang diberi kuasa, penasihat profesional atau pihak berkuasa berkaitan.
